With nary a snow flake on the ground or in the forecast, welcome to\u00a0<a href=\"http:\/\/www.halifax.ca\/snow\/documents\/2010WinterParkingRegulation.pdf\" target=\"_blank\">HRM&#8217;s Winter Parking Ban<\/a> [PDF] (not to go off on a tangent, but this is a document that equates pedestrian traffic with congestion&#8230; uh what?).<\/p>\n<p>Merry Christmas! The Grinch came by early.<\/p>\n<p><!--more--><\/p>\n<p>The ban imposed by the Halifax Regional Municipality&#8217;s <a href=\"http:\/\/www.halifax.ca\/traffic\/Who_We_Are.html\">Traffic Authority<\/a> prohibits parking between 1 a.m. and 7 a.m. in all weather conditions over the winter. The Traffic Authority is legislated through the Provincial Motor Vehicle Act and decisions are\u00a0not open to appeal.<\/p>\n<p>Metro <a href=\"http:\/\/www.metronews.ca\/halifax\/local\/article\/398432--councillors-give-cold-shoulder-to-winter-parking-ban-tax-grab\">reported<\/a> that 200 tickets were given out on the first night, amounting to a\u00a0$10,000 influx in the coffers, while municipal spokesperson Shaune MacKinlay said it was up to\u00a0<a href=\"http:\/\/thechronicleherald.ca\/Metro\/1158182.html\">386 tickets given out<\/a>. Last year, 17,468 tickets were doled out during the period of the ban, and at $25 each \u2014\u00a0the fine increased to $50 this year \u2014 the total\u00a0amounted to\u00a0<a href=\"http:\/\/www.cbc.ca\/canada\/nova-scotia\/story\/2009\/12\/15\/ns-halifax-winter-parking-ban.html\" target=\"_blank\">$436,700<\/a> in city coffers.<\/p>\n<p><strong>Dilemma A<\/strong><\/p>\n<p>If HRMbyDesign hopes to densify and reverse the trend of peninsular population loss \u2014 25,000 in the last few decades \u2014 by &#8216;encouraging larger apartment units&#8217;, they need to provide parking spaces for newer residents until Metro Transit\u00a0<span style=\"color: #000000;\">is able to catch up with this growth<\/span>.<\/p>\n<p>When there are four flats in a house with one driveway, who are you supposed to penalize? Should the onus rest on the occupants of the building or the owner of the property?<\/p>\n<p><strong>Dilemma B<\/strong><\/p>\n<p>Marielle Picher&#8217;s\u00a0<a href=\"http:\/\/thecommoner.kingsjournalism.com\/?p=719\">piece<\/a> in\u00a0<em>The Halifax Commoner<\/em> from last winter discusses the dilemma provided by the blanket parking ban on nightlife in downtown Halifax. It not only affects designated drivers but staff at establishments that close well after the parking ban goes into effect at 1am.\u00a0Metro Transit doesn&#8217;t help either since buses stop running by midnight.<\/p>\n<p><strong>Dilemma C<\/strong><\/p>\n<p>How do people like doctors and surgeons \u2014 who are excluded from the <a href=\"http:\/\/www.halifax.ca\/snow\/documents\/2010WinterParkingRegulation.pdf\">Winter Parking Regulations<\/a> [PDF] among other emergency workers who are on call \u2014 differentiate their car from others so it doesn&#8217;t get towed? With a post-it note? There needs to be a coordinated effort by the city to handle this issue.<\/p>\n<p><strong>Dilemma D<\/strong><\/p>\n<p>Now before anyone gets the wrong idea, I&#8217;m neither a fan of cars nor am I suggesting that owners have a right to park on the street during snow\/ice clearing operations.<\/p>\n<p><span style=\"color: #000000;\">Nevertheless, a<\/span>t its\u00a0best,\u00a0<em>Section\u00a0202<\/em> of the\u00a0<a href=\"http:\/\/www.gov.ns.ca\/legislature\/legc\/statutes\/motorv.htm\">Motor Vehicle Act<\/a> (which provides the Traffic Authority with the power to ban parking overnight) is redundant in ensuring clear streets, while at its\u00a0worst, it\u00a0penalizes\u00a0and criminalizes\u00a0citizens, oddly resulting in another revenue stream for the City.<\/p>\n<p>In contrast,\u00a0<em>Section <\/em><em>139<\/em> of the MVA\u00a0already enables the authorities to ticket\/tow the offending sight of a vehicle on a street if it&#8217;s impeding snow\/ice clearing operations (day or night). <span style=\"color: #000000;\">Inconsistently,<\/span> <em>Section <\/em><em>202<span style=\"font-style: normal;\"> allows them to ticket\/tow the vehicle no matter what the conditions are overnight (see\u00a0<a href=\"https:\/\/www.halifax.ca\/Council\/documents\/020305ca1023.pdf\">Supplementary Report to Council, 2002<\/a> [ PDF ]).<\/span><\/em><\/p>\n<p><strong>Remarks<\/strong><\/p>\n<p>Since clear streets for snow and ice operations is the main logic behind the ban, shouldn&#8217;t the ban only be enforced when there is snow and ice to clear?<\/p>\n<p>Councillor Dawn Sloane submitted a residents&#8217; petition last winter asking the Winter Parking Ban to be rescinded.\u00a0A\u00a0<a href=\"http:\/\/www.halifax.ca\/council\/agendasc\/documents\/090203cai03.pdf\">report<\/a> [ PDF ]\u00a0was then filed. \u00a0This winter, Councillor Sloane brought forward <a href=\"http:\/\/www.metronews.ca\/halifax\/local\/article\/420807--petition-sparks-review-of-overnight-parking-ban\">another petition<\/a> asking for a review of the current policy at the Regional Council Meeting. It <span style=\"color: #000000;\">passed on Tuesday night, and a<\/span>nother report is expected in 30 days.<\/p>\n<p>I&#8217;ve tried to understand this ban as being more\u00a0environmentally\u00a0friendly, but it&#8217;s not. If this was truly an idea to encourage more sustainable forms of transport then  <span style=\"color: #000000;\">the City and the province would make public transit and cycling infrastructure a clear priority instead of <a href=\"http:\/\/www.thecoast.ca\/halifax\/revving-for-a-fight\/Content?oid=960606\">appropriating<\/a> front <a href=\"http:\/\/www.thecoast.ca\/halifax\/bulldozers-stalled-on-chebucto-road\/Content?oid=963039\">yards<\/a> to widen <a href=\"http:\/\/www.thecoast.ca\/halifax\/chebucto-road-reconstruction\/Content?oid=963092\">car lanes<\/a>.<\/span><\/p>\n<p>A considered approach would be to ban parking ahead of an impending storm, when it&#8217;s actually required and what the law is intended towards.\u00a0A telephone snowline, website updates and TV\/radio announcements are a few ways information could be easily disseminated about that particular night&#8217;s ban.<\/p>\n<p>Granted, maritime winters with rapid cycles of freeze and thaw pose a significant challenge\u00a0to clearing crews. Alternate side street parking &#8211; enforced day and night &#8211; in areas of high car density, particular to multiple family dwellings\u00a0neighbourhoods, may be a viable option. It would enable alternate sides of the street cleared on consecutive days and provide people with an option that doesn&#8217;t cost them $50 per infraction.<\/p>\n<p>The final decision for the ban currently rests with the Traffic Authority, whose power is derived from the <span style=\"color: #000000;\">pr<\/span>ovince, not Council. This process needs to change.
