{"id":33085,"date":"2012-08-28T08:45:39","date_gmt":"2012-08-28T12:45:39","guid":{"rendered":"http:\/\/spacingtoronto.ca\/?p=33085"},"modified":"2012-08-28T07:59:01","modified_gmt":"2012-08-28T11:59:01","slug":"lorinc-conflicting-accounts-of-fords-declarations-of-conflict","status":"publish","type":"post","link":"https:\/\/spacing.ca\/toronto\/2012\/08\/28\/lorinc-conflicting-accounts-of-fords-declarations-of-conflict\/","title":{"rendered":"LORINC: Conflicting accounts of Ford\u2019s declarations of conflict"},"content":{"rendered":"<p><a href=\"http:\/\/spacing.ca\/network\/wp-content\/uploads\/sites\/4\/2012\/08\/football-closeup.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-33088\" title=\"football-closeup\" src=\"http:\/\/spacing.ca\/network\/wp-content\/uploads\/sites\/4\/2012\/08\/football-closeup-600x398.jpg\" alt=\"\" width=\"600\" height=\"398\" srcset=\"https:\/\/spacing.ca\/toronto\/wp-content\/uploads\/sites\/4\/2012\/08\/football-closeup-600x398.jpg 600w, https:\/\/spacing.ca\/toronto\/wp-content\/uploads\/sites\/4\/2012\/08\/football-closeup.jpg 1024w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone\" src=\"http:\/\/spacing.ca\/network\/wp-content\/uploads\/sites\/4\/2011\/12\/feature-lorinc.gif\" alt=\"\" width=\"600\" height=\"85\" \/><\/p>\n<p>In Monday\u2019s Globe and Mail, <a href=\"http:\/\/www.theglobeandmail.com\/news\/toronto\/documents-hint-at-mayor-rob-fords-defence-in-conflict-of-interest-case\/article4500451\/?page=2\">my colleague Kelly Grant reported<\/a> that Mayor Rob Ford, during a deposition involving the pending conflict of interest proceeding, told lawyer Clayton Ruby that he didn\u2019t recall reading the Council handbook and said, repeatedly, that \u201che relied on the city solicitor to tell him when he was supposed to declare a conflict and recuse himself from a debate and a vote.\u201d<\/p>\n<p>\u201c`It\u2019s up to staff to give that answer why, many different reasons,\u2019\u201d Ford is quoted as telling Ruby, who is representing resident Paul Magder.<\/p>\n<p>The mayor can duck the sanction \u2013 removal from office, as per section 10(1) of the <a href=\"http:\/\/www.e-laws.gov.on.ca\/html\/statutes\/english\/elaws_statutes_90m50_e.htm\">municipal conflict of interest act<\/a> \u2014 if he persuades a court next week that he either inadvertently failed to declare a conflict of interest or erred in judgment during a February council debate about the integrity commissioner\u2019s latest report on Ford\u2019s practice of hitting up lobbyists for donations to his football foundation.<\/p>\n<p>What\u2019s strange is that Ford, as a councillor, frequently declared conflicts prior to certain agenda items, thereby excusing himself from the ensuing debate.<\/p>\n<p>By my count, there are 28 council items on the city\u2019s website indicating that Ford had declared a conflict between 2000 and 2010. Many have to do with council procurement decisions that involve printing (his family owns Deco Labels and Tags, a printing company). <a href=\"http:\/\/www.toronto.ca\/legdocs\/2006\/minutes\/council\/cc060725.pdf\">At a July, 2006 council meeting [ PDF ]<\/a>, for example, he recused himself from an item before the administration committee about the replacement of a forklift and other equipment in the city\u2019s printing shop.<\/p>\n<p><!--more--><\/p>\n<p>Other declarations have been even more subtle.<a href=\"http:\/\/www.toronto.ca\/legdocs\/mmis\/2007\/cc\/minutes\/2007-11-19-cc14-mn.pdf\"> In November, 2007 [ PDF ]<\/a>, he bowed out of a debate about a licensing standards item on the location of illegal billboard signs, as one of the signs referenced was \u201cin the vicinity\u201d of the headquarters of Deco Labels and Tags, the family business.<\/p>\n<p>More curious still <a href=\"http:\/\/www.toronto.ca\/legdocs\/mmis\/2009\/ey\/bgrd\/backgroundfile-18431.pdf\">is this report [ PDF ]<\/a>, approved by Etobicoke community council and then council as a whole in 2009, about reduced speed limits on residential streets near Ford\u2019s home on Edenbridge Drive. City staff and the local councilor had asked for a 40 km\/hr limit on a handful of streets just north of Ford\u2019s home. Ford, for his part, declared a conflict because of the location of his house.<\/p>\n<p>That declaration seemed like a bit of bending over backwards: as Ford\u2019s own property isn\u2019t actually located on the streets affected by the change in limit, it\u2019s hard to know how his vote would have posed a conflict or created a pecuniary benefit.<\/p>\n<p>The point is that the mayor, in the past, seems to have been familiar enough with the municipal conflict laws, and attentive enough to council debates, to know when to stick his hand up after the speaker asks for declarations of conflict.<\/p>\n<p>What\u2019s more, as the speed limit items suggest, Ford \u2013 either out of a genuine belief in the potential conflict or for reasons of show \u2013 erred on the side of caution when it came to items that may have even the slightest link to his personal interests.<\/p>\n<p>Needless to add, the councillor from Ward 2 wasn\u2019t getting bespoke legal advice from the city solicitor during any of these sessions. I\u2019m not suggesting that Ford has some kind of secret, well-disguised knowledge of the conflict laws. Rather, he had an executive assistant who had his boss\u2019s back and, in all likelihood, dutifully flagged anything that might have smelled even a little bit sour.<\/p>\n<p>In case anyone\u2019s forgotten, the specific conflict allegation against Ford arose because he participated in a council debate last February over the integrity commissioner\u2019s recommendation that he reimburse the $3,150 in donations, <a href=\"http:\/\/www.toronto.ca\/legdocs\/mmis\/2012\/cc\/bgrd\/backgroundfile-44902.pdf\">as previously instructed [ PDF ]<\/a>, ergo the pecuniary interest.
