{"id":898,"date":"2006-06-21T11:25:28","date_gmt":"2006-06-21T15:25:28","guid":{"rendered":"http:\/\/spacingtoronto.ca\/?p=898"},"modified":"2006-06-21T19:33:50","modified_gmt":"2006-06-21T23:33:50","slug":"port-authority-sues-communityair","status":"publish","type":"post","link":"https:\/\/spacing.ca\/toronto\/2006\/06\/21\/port-authority-sues-communityair\/","title":{"rendered":"Port Authority sues CommunityAIR"},"content":{"rendered":"<p><img decoding=\"async\" align=\"right\" src=\"http:\/\/images1.jetphotos.net\/images\/2\/20050521_cytz.jpg.25356.jpg.thumb\" \/>According to the CBC, the Toronto Port Authority has filed a $3-million lawsuit against CommunityAIR, (the group that helped stop the bridge to the airport) and some of its members for defamation. <span class=\"features\"> <\/span>The article states, &#8220;In its statement of claim, the federal agency alleges it has been defamed by members of Community Air, a non-profit group that has been highly critical of the dealings of the federal agency over the years.&#8221;<\/p>\n<p>John Barber of the <em>Globe and Mail<\/em> <a href=\"http:\/\/www.theglobeandmail.com\/servlet\/story\/LAC.20060621.BARBER21\/TPStory\/National\/HYOntario\">wrote a column<\/a> about this today [you can also <a href=\"http:\/\/communityair.org\/Press_Coverage\/20060621-Globe_and_Mail-Barber.pdf\">download a PDF<\/a> of the column if you can&#8217;t get into the Globe&#8217;s website]. He claims the lawsuit is worth $6.8 million when you include the seven directors also included in the filing. He also says, &#8220;The lawsuit also demands an injunction preventing the volunteer activists from making any more allegedly defamatory statements about the federal agency &#8212; a category of speech, according to the wide-open statement of claim the authority filed in court last week, that would seem to include every public statement any of the activists has ever made in this hotly contested, thoroughly aired, public debate.&#8221;<\/p>\n<p>Obviously, the timing of the lawsuit is &#8220;coincidental&#8221; with a federal review of the authority&#8217;s dubious activities, with a report to be handed down in September (just in time to make the island another election issue for Mayor Miller. As a side note, I wonder how Lady Jane Pitfield will react to this announcement).<\/p>\n<p>Spacing&#8217;s managing editor Dale Duncan also pointed out to me that the TPA&#8217;s lawsuit actually may help CommuntiyAIR &#8212; if the TPA lawsuit is not won, then CA&#8217;s claims will have been vaildated by the court.<\/p>\n<p>I also wonder if anyone can sue the Port Authority for misleading the public in their commercials that are airing on Toronto radio stations (and the misuse of public funds)? The TPA also doesn&#8217;t seem to want to <a href=\"http:\/\/www.torontoport.com\/PortAuthority\/media_releases.asp\">publish a press release<\/a> about the lawsuit, but you can read all about how the they loaded six 80-tonne Electromotive locomotives aboard the Jumbo Line&#8217;s Daniella (see below).
