{"id":37051,"date":"2024-06-17T10:00:12","date_gmt":"2024-06-17T17:00:12","guid":{"rendered":"https:\/\/spacing.ca\/vancouver\/?p=37051"},"modified":"2025-08-14T11:04:47","modified_gmt":"2025-08-14T18:04:47","slug":"broadway-plan-shenanigans","status":"publish","type":"post","link":"https:\/\/spacing.ca\/vancouver\/2024\/06\/17\/broadway-plan-shenanigans\/","title":{"rendered":"Broadway Plan Shenanigans"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large\" src=\"http:\/\/spacingmedia.com\/spacingvancouver\/wp-content\/uploads\/features\/indepth_feature-VAN.gif\" width=\"600\" height=\"72\"><\/p>\n<p class=\"p1\"><span class=\"s1\">Lawrence Peter &#8220;Yogi&#8221; Berra once said: \u201cIf you don\u2019t know where you are going, you\u2019ll end up someplace else.&#8221; This is top of mind for many as the <a href=\"https:\/\/vancouver.ca\/news-calendar\/advancing-the-broadway-plan-june-2024.aspx\">City of Vancouver kicked off four open houses on Saturday<\/a>\u2014the first in a series that will be held over the next week and a half to gather feedback on proposals related to the <a href=\"https:\/\/spacing.ca\/vancouver\/2022\/09\/12\/broadway-plan-reflections\/\">controversial <i>Broadway Plan<\/i><\/a>. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><a href=\"https:\/\/cityhallwatch.wordpress.com\/2024\/06\/15\/rezoning_1540w10th_breaks_broadway_plan\/\">A recently published analysis<\/a> of the proposed 21-storey tower at 1540 West 10th Avenue\u2014with its <a href=\"https:\/\/www.shapeyourcity.ca\/1540-w-10-ave\">Q&amp;A session<\/a> concluding on June 18<\/span><span class=\"s2\"><sup>th<\/sup><\/span><span class=\"s1\">\u2014continues the controversial handling of the <i>Plan<\/i> to date, highlighting a project that breaches regulations within the <i>Broadway Plan<\/i> itself. This is the second iteration of a design that <a href=\"https:\/\/cityhallwatch.wordpress.com\/2022\/09\/12\/1st-proposal-violates-broadway-plan-reliance-1540-w10th\/\">initially violated the Plan\u2019s regulations<\/a> and has left the public dazed and confused, further fracturing the little trust remaining between the City and Vancouver citizens.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Designed by the <a href=\"https:\/\/www.officemb.ca\/\">office of mcfarlane biggar architects + designers<\/a> and submitted by <a href=\"https:\/\/relianceproperties.ca\/\">Reliance Properties<\/a>\u2014led by CEO Jon Stovell\u2014the proposal includes 112 rental units, 20% of which are to be below market rate. For the Number Geeks among us, a building height of 65.8 meters (226 feet) is being requested, with a floor space ratio (FSR) of 6.5. The final rendered elevation is on the right (without terrain).<\/figcaption><\/figure>\n<p class=\"p3\"><span class=\"s1\">The property was assessed at $8,483,700 as of July 1, 2023, with nearly all value attributed to the land. There has been no sales history in the past three years. The current ownership includes members of the Chechik, Cohen, Goldstein, and Leshgold families. <\/span><span class=\"s1\">The <a href=\"https:\/\/cityhallwatch.wordpress.com\/2024\/06\/15\/rezoning_1540w10th_breaks_broadway_plan\/\">analysis<\/a><\/span><span class=\"s3\"> also raises questions about the dynamics and beneficiaries of such rezoning initiatives.<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">The design, described as a \u2018tower in the park,\u2019 fails to comply with the Broadway Plan&#8217;s specifications across several issues and scales. Some of the key ones are summarized below. More specifically, the proposal would cast shadows over solar-protected greenspace during the pivotal hours between 10 am and 4 pm on the spring and fall equinoxes. This proposed rezoning would violate the solar protection rules by introducing new shadow between the spring and fall equinox (at any time between 10am to 4pm) as evident here with the shadow impact for March 20 at 10am.<\/figcaption><\/figure>\n<p class=\"p4\"><span class=\"s1\">Building height is another area of contention. According to the analysis, the floor-to-floor height maximums of 3.0m are exceeded. In the future, these heights could be reduced a little to allow two extra storeys in the later development permit stage. This is an often-used<span class=\"Apple-converted-space\">&nbsp; <\/span>\u201cbait and switch\u201d tactic that can ultimately lead to the final building exceeding the maximum storeys allowed by the <i>Broadway Plan<\/i>.<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">Infractions are apparent even at the scale of the apartment unit. The analysis shows that the tower&#8217;s floor plans include two suites per level that lack balconies, deviating directly from the requirement of each dwelling having an outdoor living space.<\/span><\/p>\n<figure id=\"attachment_37061\" aria-describedby=\"caption-attachment-37061\" style=\"width: 600px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/spacing.ca\/vancouver\/wp-content\/uploads\/sites\/6\/2024\/06\/2_no_balcony_suites.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-37061\" src=\"http:\/\/spacing.ca\/vancouver\/wp-content\/uploads\/sites\/6\/2024\/06\/2_no_balcony_suites-600x167.jpeg\" alt=\"\" width=\"600\" height=\"167\" srcset=\"https:\/\/spacing.ca\/vancouver\/wp-content\/uploads\/sites\/6\/2024\/06\/2_no_balcony_suites-600x167.jpeg 600w, https:\/\/spacing.ca\/vancouver\/wp-content\/uploads\/sites\/6\/2024\/06\/2_no_balcony_suites-300x83.jpeg 300w, https:\/\/spacing.ca\/vancouver\/wp-content\/uploads\/sites\/6\/2024\/06\/2_no_balcony_suites-768x214.jpeg 768w, https:\/\/spacing.ca\/vancouver\/wp-content\/uploads\/sites\/6\/2024\/06\/2_no_balcony_suites-940x262.jpeg 940w, https:\/\/spacing.ca\/vancouver\/wp-content\/uploads\/sites\/6\/2024\/06\/2_no_balcony_suites.jpeg 1024w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><figcaption id=\"caption-attachment-37061\" class=\"wp-caption-text\">Required balconies have been omitted for some of units within the building, including the two studio units per level above.<\/figcaption><\/figure>\n<p class=\"p4\"><span class=\"s1\">This proposal has ultimately ignited a flurry of questions about the <i>Broadway Plan<\/i>&#8216;s integrity and the forces driving such rezonings and other municipal behaviours. Speculations swirl about the influence of political donations on policy decisions and who truly reap the benefits of these developments. Within this chaos, it\u2019s unclear who is protecting the public interest and what is motivating the City\u2019s blatant violation of its own rules. <\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">In a classic case of baptism by fire, Chief Planner Josh White\u2014who took office on May 1, 2024\u2014faces calls to rigorously enforce the <i>Broadway Plan<\/i>&#8216;s guidelines. City Manager Paul Mochrie, Mayor Ken Sim, and the City Council are certainly not off the hook, as it is their responsibility to uphold public trust as the city transitions the <i>Vancouver Plan<\/i> into the <i>Official Development Plan<\/i>\u2014an act that will eventually <i>phase out<\/i> public hearings checks and balances. As Piper Stone once said: \u201cTrust is earned, not given\u201d and this situation offers the City an opportunity to earn public trust that has been on a rapid decline since <a href=\"https:\/\/spacing.ca\/vancouver\/2023\/04\/03\/ken-sims-swagger-and-the-language-of-inequality\/\">Sim swaggered his way into office<\/a>. <\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">Vancouverities must also be held accountable, however. This is an opportunity\u2014dare I say, a responsibility\u2014to speak up and demand answers to the shroud behind which the City continues to operate. Public consultation for the rezoning\u2014which was posted on May 17, 2024\u2014allows for direct feedback through an <a href=\"https:\/\/www.shapeyourcity.ca\/1540-w-10-ave?tool=survey_tool&amp;tool_id=feedback#tool_tab\">online form<\/a> until June 18th. Citizens can also post questions on the <a href=\"https:\/\/www.shapeyourcity.ca\/1540-w-10-ave?tool=qanda#tool_tab\">ShapeYourCity<\/a> page, where staff supposedly promise responses within two days. However, those who submit questions would be wise to keep track of their submission and whether questions are answered or not. <\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">In a city forever evolving, Vancouver finds itself at a critical moment. The integrity of current city planning and processes rightfully stands under scrutiny. The expectation is clear: the public interest must be safeguarded\u2014a tall order from a City that cannot even honour its own rules, but not an impossible one if citizens demand accountability and transparency.<span class=\"Apple-converted-space\">&nbsp; <\/span>There is still time to move towards a place we know we want to end up.<span class=\"Apple-converted-space\">&nbsp; &nbsp;<\/span><\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><em><span class=\"s1\">Below are a few excerpts of the <a href=\"https:\/\/vancouver.ca\/home-property-development\/broadway-plan.aspx?utm_campaign=broadway-plan&amp;utm_medium=Vanity&amp;utm_source=broadway-plan_Vanity#redirect\">Broadway Plan<\/a>. The full 500-page document is available <a href=\"https:\/\/guidelines.vancouver.ca\/policy-plan-broadway.pdf\">here<\/a>.<\/span><\/em><\/p>\n<p class=\"p1\"><strong><span class=\"s1\">Building Height<\/span><\/strong><\/p>\n<ul class=\"ul1\">\n<li class=\"li1\"><em><span class=\"s1\"><b>11.1.12<\/b> Generally, residential floor-to-floor heights of 3.0 m (10 ft.) are supported, office floor-to-floor heights of 3.65 m (12 ft.) are supported, and industrial floor-to-floor heights of 6.1 m (20 ft.) are supported.<\/span><\/em><\/li>\n<li class=\"li1\"><em><span class=\"s1\"><b>11.4.1 <\/b>A consistent 4-storey podium should be provided in residential areas to create a consistent street wall that is compatible with existing neighbourhood character and preserves solar access across the street.<\/span><\/em><\/li>\n<li class=\"li1\"><em><span class=\"s1\"><strong>Privately-Initiated Rezonings<\/strong> (<b>p. 70) <\/b>: \u201cIn all instances, the overall height, density, and form of development should be sensitive to the surrounding context. This would include consideration of street character, views, shadowing, topography, access and circulation, and privacy.\u201d<\/span><\/em><\/li>\n<li class=\"li1\"><em><span class=\"s1\">\u201cTower site frontage requirements: The Policy Area summary tables in Chapters 8-10 typically have a minimum site frontage requirement for tower forms.
